Cancellations and Refunds Policy

This Cancellations and Refunds Policy (“Policy”) sets out the terms and conditions applicable to cancellations, deposits, payments, and refunds for tours booked with Adventure Trails Tasmania (“the Company,” “we,” “us”). By making a booking with us, you (“the Participant,” “you”) agree to be bound by this Policy.

Deposits and Bookings

Deposit: To secure your booking, a non-refundable deposit of 10% of the total tour cost is required at the time of booking.

Booking Confirmation:
Your booking is only confirmed once the deposit is received. If the deposit is not received within the specified time, your booking may be canceled at the Company’s discretion.

Full Payment Due Date:
The remaining balance of the tour cost is due no later than 7 days before the scheduled start date of the tour.

Failure to Pay:
If full payment is not received by the due date, Adventure Trails Tasmania reserves the right to cancel your booking, and the deposit will be forfeited.

Cancellations by the Participant

If you cancel your booking more than 7 days before the scheduled tour start date, you will receive a full refund of any amounts paid, excluding the non-refundable 10% deposit.

If you cancel your booking within 7 days of the scheduled tour start date, you will be entitled to a refund of 60% of the total tour cost.

No refunds will be issued for cancellations made on or after the scheduled tour start date, or if you fail to arrive for your tour.

Cancellations by Adventure Trails Tasmania

Adventure Trails Tasmania reserves the right to cancel any tour for reasons including, but not limited to, weather conditions, safety concerns, insufficient participant numbers, or other unforeseen circumstances.

Refund for Cancellations by Us: If we cancel a tour for any reason other than your breach of this Policy, you will be offered either a full refund of the tour cost or the option to reschedule for an alternative date, subject to availability.

Rescheduling Dates

Participant-Initiated Rescheduling of tour date (with the same itinerary):
Requests to reschedule your tour date can be made at least 7 days prior to the scheduled tour start date. Approval is subject to availability and will be at the sole discretion of Adventure Trails Tasmania.

Participant-Initiated Rescheduling of tour date (with adjustments to itinerary):
Requests to reschedule your tour date and adjust your itinerary can be made at least 7 days prior to the scheduled tour start date. Approval is subject to availability and will be at the sole discretion of Adventure Trails Tasmania. An additional fee for itinerary changes and booking costs will be applied in this scenario.

Cancellations After Rescheduling:
If you reschedule a tour and then cancel more than 7 days before the rescheduled tour start date, you will receive a full refund of any amounts paid, excluding the non-refundable 10% deposit.

If you cancel your booking within 7 days of the rescheduled tour start date, you will be entitled to a refund of 60% of the total tour cost.

No refunds will be issued for cancellations made on or after the scheduled tour start date, or if you fail to arrive for your tour.

Refund Process

All refunds will be issued using the same payment method used for the original booking, unless otherwise agreed by Adventure Trails Tasmania.

Tour Guides: Guides must ensure the safety of participants, communicate safety procedures, and be familiar with emergency protocols. They are also responsible for assessing risks before each tour and responding to incidents.

Participants: Tour participants must comply with all safety instructions and declare any relevant health conditions. They are expected to act responsibly and use equipment provided as instructed.

External Providers: Third-party service providers, such as wineries, distilleries, or transport providers, must adhere to the safety standards of the Company and relevant industry regulations.

Risk Management
Adventure Trails Tasmania conducts regular risk assessments to identify potential hazards during all tours, especially those involving bushwalking and physical activities. These assessments will:
• Evaluate terrain difficulty and weather conditions.
• Ensure that all activities, especially bushwalking, are suitable for the fitness and experience level of participants.
• Identify risks at wineries, distilleries, and historical sites, including alcohol consumption and interactions with wildlife or local environments.

Participant Health and Fitness
Medical Conditions: Participants must disclose any medical conditions that may affect their participation. This includes allergies, respiratory issues, heart conditions, and other relevant health concerns.

Fitness Levels: Tours, particularly bushwalks, require varying levels of fitness. The Company will clearly communicate the fitness requirements of each tour. Participants are responsible for ensuring they meet these requirements.

Emergency Procedures
In case of emergencies such as injuries, medical incidents, or environmental hazards (e.g., bushfires, floods), the following procedures will apply:

First Aid: All guides will be trained in first aid and carry a first aid kit. Immediate medical attention will be provided when necessary.
Communication: Guides will carry communication devices (such as satellite phones) in remote areas to contact emergency services if needed.
Evacuation: If evacuation is necessary, guides will follow the Company’s emergency evacuation plan and coordinate with local emergency services.
Incident Reporting: Any accidents, injuries, or near-miss incidents must be reported to the Company immediately for investigation and record-keeping.

Alcohol Consumption
When visiting wineries and distilleries, participants are encouraged to drink responsibly. The following conditions apply:
Consumption Limits: Participants must not exceed a safe level of alcohol consumption, especially when engaging in physical activities afterward.
Transport: Adventure Trails Tasmania will ensure that participants do not drive under the influence by providing safe transport options.
Legal Compliance: All alcohol consumption will comply with Tasmania’s licensing and legal drinking age requirements.

Environmental Protection and Cultural Sensitivity
Adventure Trails Tasmania is committed to protecting the natural and cultural environments in which we operate:
Leave No Trace: Participants must adhere to the “Leave No Trace” principles during bushwalks and visits to natural sites, ensuring minimal impact on the environment.
Cultural Sites: When visiting historical and cultural sites, participants must respect local regulations, avoid damaging heritage areas, and follow the guide’s instructions regarding conduct.

Insurance and Liability

Company Insurance: Adventure Trails Tasmania holds public liability insurance and relevant coverage for participants during the tours.
Participant Acknowledgment: All participants will be required to sign a waiver acknowledging that they understand the risks associated with adventure tours, including bushwalking and other physical activities.
Third-Party Liability: The Company ensures that any third-party providers (e.g., wineries, transport operators) involved in the tour have adequate insurance coverage.

Equipment and Safety Gear

Company Responsibility: The Company will provide and maintain all necessary equipment for safe bushwalking and outdoor activities. This includes ensuring the availability of appropriate safety gear such as helmets, hiking poles, or other items where necessary.
Participant Responsibility: Participants are responsible for bringing appropriate personal equipment such as hiking boots, weather-appropriate clothing, and sunscreen, as outlined in the pre-tour briefing. They are also expected to use company-provided equipment in accordance with instructions.

COVID-19 and Infectious Diseases
Adventure Trails Tasmania adheres to all Tasmanian and national health guidelines regarding COVID-19 and other communicable diseases:

Health Screening: Participants must confirm that they are free of COVID-19 symptoms before joining a tour.
Hygiene: Guides will enforce hygiene protocols, including the availability of hand sanitizers and ensuring social distancing when necessary.
Isolation and Medical Attention: If a participant develops symptoms during a tour, they will be isolated and medical assistance sought as necessary.

Training and Compliance

Participants: Participants who breach this policy, particularly by engaging in inappropriate or unsafe behavior due to intoxication, may be excluded from the tour and may not be entitled to refunds or other compensation.

Terrain: The nature of the terrain, including difficulty, elevation, and potential hazards such as loose rocks, steep inclines, and slippery surfaces.

Weather Conditions: The current and forecasted weather, including risks related to extreme heat, cold, rain, storms, or high winds.

Wildlife: Possible encounters with wildlife, including dangerous animals, insects, and plants that may pose risks.

Participant Fitness Levels: The physical demands of the bushwalk, ensuring that it is suitable for the group’s fitness and experience levels.
